Terms & Conditions

The following Terms & Conditions are in place to ensure everything runs smoothly and that your experience is seamless from booking through to your event.

  

Booking & Deposit 

A non-refundable deposit of $300.00 is required to secure your booking.  Dates will be held for a maximum of 7 days without receipt of the deposit. Your booking is only confirmed once the deposit has been received. 



Payment


The remaining balance must be paid in full no later than 30 days prior to the event date. Payments are accepted via bank transfer (details provided on invoice). If the event is booked within 30 days of the performance date, full payment is required at the time of the booking. 


If payment is not received by the due date, the Performer reserves the right to release the booking and retain the booking deposit, unless otherwise agreed in writing.



Travel 


Travel within a 20 km radius of the Melbourne GPO is included. For venues located beyond this radius, additional travel charges will apply including tolls. Parking fees will be charged where applicable, depending on the venue requirements. 



Setup & Performance 


A minimum of 60 minutes setup time is required before the performance. 


Music is performed live on violin, accompanied by professionally produced backing tracks to create a full and immersive sound.


For outdoor performances, the Client must provide suitable cover or shelter to protect the Performer and equipment from weather conditions, including sun, heat, wind, or rain.


In cases of extreme heat (approximately 35°C or above) or direct sun exposure that may risk damage to the Performer’s instrument or equipment, the Performer reserves the right to relocate to a shaded or suitable area or adjust or cease the performance if required. 


The Client is responsible for ensuring a safe and suitable performance space is provided, including adequate room for equipment setup and operation, with the area to be level, stable, and free from hazards, and with appropriate access for setup and pack-down.


Where possible, a space of approximately 2m x 2m is recommended to allow for equipment and performance comfort.


Where required, access to power must be available within a reasonable distance of the performance area.


The Performer generally performs two sets of thirty (30) minutes with a short five-minute break in between or sets of forty-five (45) minutes with a fifteen-minute break for bookings over one hour. These timings are a guide and may be adjusted in consultation with the Client to best suit the flow of the event. Breaks are kept minimal to ensure the music continues to create a seamless atmosphere, and suitable backing music will be played during any breaks. 


If the event runs later than the scheduled start time, the performance time may be adjusted to remain within the originally agreed booking period, particularly where the Performer has other scheduled commitments on the day. The Performer will make reasonable efforts to accommodate timing adjustments where possible, however performance times will remain within the originally agreed booking period. 


Attire will be formal unless otherwise requested. 


Clients may request up to two specific songs outside of the provided repertoire. These requests must be submitted at least two months in advance and will be accommodated where feasible. A fee per song may apply, depending on the availability of backing tracks, sheet music, or other necessary materials.



Event Changes


Any changes to the event details, including date, time, or location, must be communicated in writing. Changes made within 30 days of the event may incur additional fees and are subject to availability.



Cancellations & Unforeseen Circumstances 


Cancellations must be made in writing. 


• More than 30 days prior: any payments made will be refunded, excluding the non-refundable booking deposit.


• 14-30 days prior: 50% of the total fee will be retained.


• Less than 14 days prior: the full fee will be retained.


• Rescheduling may be offered at the Performer’s discretion, subject to availability. A rebooking fee may apply to help cover time, preparation, and travel already undertaken, with any rescheduled date to be confirmed within 12 months of the original booking date.


• If the Performer must cancel due to illness, emergency, or extreme weather, all monies (including deposit) will be refunded in full. 


• While this is highly unlikely, the Performer recommends that the Client prepares a backup playlist or recording of favourite pieces to ensure music is available should unforeseen circumstances prevent live performance.


• The Performer always carries professional backup equipment, including instruments and sound systems, to minimise the risk of disruption and to ensure the performance can continue wherever possible. In the unlikely event that unforeseen technical issues, power failure, or circumstances beyond the Performer’s reasonable control prevent or significantly impact the performance and cannot be resolved despite best efforts, any liability is limited to the return of fees paid for the affected portion of the service.




Recording & Media 


Guests, photographers, and videographers are welcome to record the performance for personal use. 


The Performer may use recordings or photographs for promotional purposes (e.g., website/social media). 


If you prefer not to have your names/venue shared, please advise in writing. 



Liability & Insurance 


The Performer is fully responsible for their own equipment and conduct. The Performer is not liable for failure to perform due to circumstances beyond their control (e.g., illness, weather, accidents). 


The Client is responsible for ensuring that guests and venue staff do not interfere with the Performer’s instruments or equipment. Any damage caused to instruments or equipment during the event may be the responsibility of the Client or venue.


The Performer’s liability is limited to the amount already paid by the Client. 



Governing Law 


These Terms & Conditions are governed by the laws of the State of Victoria, Australia. 


Acceptance of Terms 

By proceeding with payment of the booking deposit, you acknowledge and agree to these Terms and Conditions.
